• Competitor analysis and backlink tracking
• Integration with third-party services including Google Search Console and Google Analytics
• Performance reporting and analytics dashboards

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Security

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and not share it with third parties
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Subscription Plans and Billing

4.1 Free Trial

We offer a 7-day free trial for new users. No credit card is required to start the trial. At the end of the trial period, you may choose to subscribe to a paid plan or your account will revert to a limited free tier.

4.2 Paid Subscriptions

Paid subscription plans are billed on a monthly or annual basis as selected at the time of purchase. All fees are stated in US dollars and are exclusive of applicable taxes. By providing payment information, you authorize us to charge the applicable fees to your payment method.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us at [email protected].

4.4 Refunds

We offer a 30-day money-back guarantee for first-time subscribers on annual plans. Monthly subscriptions are non-refundable after the billing period has started. Refund requests must be submitted within the applicable refund window by contacting our support team.

4.5 Price Changes

We reserve the right to modify subscription prices with at least 30 days' written notice. Continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

5. Acceptable Use Policy

You agree not to use the Service to:

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this policy, including suspending or terminating accounts without refund.

6. Intellectual Property

The Service and its original content, features, functionality, design, software, algorithms, and underlying technology are and will remain the exclusive property of Prolific SEO and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.2 Your Content

You retain ownership of any content you submit, upload, or create using the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display Your Content solely for the purpose of providing and improving the Service.

6.3 AI-Generated Content

Content generated by our AI tools is provided as a starting point and should be reviewed and edited before publication. You are responsible for ensuring that any AI-generated content you publish complies with applicable laws and does not infringe third-party rights. We make no warranty regarding the accuracy, originality, or fitness for purpose of AI-generated content.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation to you.

7. Third-Party Integrations and Services

The Service integrates with third-party services including Google Search Console, Google Analytics, and Stripe for payment processing. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

By connecting third-party accounts to Prolific SEO, you authorize us to access and use data from those accounts as necessary to provide the Service. You can revoke these authorizations at any time through your account settings or the respective third-party service.

8. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

SEO results depend on many factors outside our control, including search engine algorithm changes, competitive landscape, and website quality. We do not guarantee specific ranking improvements or traffic increases.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROLIFIC SEO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Prolific SEO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to Your Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, we will delete your account data in accordance with our Privacy Policy, subject to any legal retention obligations.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification to registered users.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Prolific SEO regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
